      2. Lodging of appeals
         

         Dans un délai de 2 mois à compter de la notification de la décision de rejet de leur candidature ou de leur offre, les candidats peuvent former un recours gracieux, lequel interrompt le cours de ce délai.

         Les candidats évincés peuvent, une fois le contrat signé, saisir le TA d"un référé contractuel (art L551-13 et suivants et R551-7 et suivants du CJA) jusqu"au 31ème jour suivant la publication de l"avis d"attribution.

         Dans un délai de 2 mois à compter de la publication de l’avis d’attribution, les concurrents évincés de la conclusion d"un contrat administratif, ainsi que les tiers, sont recevables à former un recours devant le TA en pleine juridiction contestant la validité de ce contrat ou de certaines de ses clauses, qui en sont divisibles, assorti, le cas échéant, de demandes indemnitaires (Recours « Tropic » Conseil d"Etat « Tropic travaux signalisations » du 16.7.2007 et Conseil d’État, Assemblée, 4.4.2014, no358994).

         Une requête contestant la validité du contrat peut être accompagnée d"une demande tendant à la suspension de son exécution (art L521-1 du CJA). La suspension desdites décisions peut également être demandée devant le juge des référés du même TA (art L521-1 du CJA). La requête en référé devra, pour être recevable, être assortie d"un recours au fond.
