         L"objectif de l"étude de gouvernance préalable à la mise en place de la compétence Gemapi sur l"unité hydrographique IF5 est de formuler des propositions de gouvernance durable et de déterminer une structure porteuse à l"échelle du bassin-versant «Essonne-Juine-École» pour porter la compétence Gemapi et d"intégrer une vision à moyen terme des travaux à réaliser.

         Ainsi, le présent marché a pour objet de confier au prestataire retenu une mission d"expertise de l"organisation des maîtrises d"ouvrages en place et de propositions de scénario d"évolution au regard de la loi Maptam et plus particulièrement de la mise en place de la compétence Gemapi à l"échelle du bassin-versant «Essonne-Juine-École».

      La directive-cadre sur l"eau, la directive inondation, les lois du grenelle de l"environnement et le Sdage Seine-Normandie, fixent des objectifs environnementaux. Atteindre ces derniers nécessite la mise en œuvre d"actions concrètes portées par des structures travaillant à une échelle d"intervention cohérente et munies de compétences adaptées.

      Les lois (françaises) Maptam et NOTRe demandent la mise en place d"une gouvernance adaptée et d"une nouvelle structuration de la maîtrise d"ouvrage publique.

      Compte tenu, d"une part, des missions d"assistance à la gestion des milieux aquatiques (GEMA) exercées par les 4 syndicats existants, et d"autre part, des missions de prévention des inondations (PI) menées essentiellement par le Siarce, il apparaît tout à fait opportun d"étudier les scénarios possibles consistant à conserver ou transférer la compétence Gemapi par les EPCI vers les structures en place et/ou à créer.
